契約書翻訳、とくに和文英訳の場合、日本語の「有無」、「可否」、「諾否」、「良否」、「成否」、「真偽」等の漢字２語からなる言葉を使うことがあります。これらは日常の文章や法律文でも使われています。漢字２語で表すとわずか２語からなる言葉ですが、英文に置き換える場合、同じ言葉でも、その内容・文脈等により意味合いの異なる場合もあり、その意味を体現した訳語を使う必要があります。
例えば、日本語の「有無」は、「物事や事物のあること、ないこと」のほかに「承諾すること、断ること」、「存在するものと存在しないもの、または、存在することと存在しないこと」等の意味があります。
漢字は、表意文字であり、文字の1つ1つに意味があり、特定の事物と対応してそれを象徴する文字です。さらに日本語の漢字は、表意文字としての機能に加え、音も表し、語彙としての機能も併せ持っていいます。和英辞典には、これらの言葉に対応するそれなりの単語が掲載されていてますが、すでに述べたように内容・文脈等により、適切にその意味を体現した訳語を用いる必要があります。経験的にも、これられの言葉を辞書にある一見対応する英単語をそのまま使って表すケースは以外と少ないようです。また、内容によっては辞書に記載されていない単語を組み合わせて文章を作成する必要がある場合もあります。
今回は、これらの中から、特に内容・文脈等を踏まえて、作成した例文（法律文を除く）を通して、ごく一部ですが幾つかの例を見てゆきます。
1. 「有無」
この言葉の事本的な日本語の意味については、冒頭で述べた通りです。「有無」という意味の英単語で思い浮かべるのは、基本的には「existence or non-existence」;「presence or absence」です。いくつかの和英辞典で「有無」を調べてみると、基本的には「existence or non-existence」;「presence or absence」、「承諾すること、断ること」＝「諾否」は、「yes or no」とあります。（もちろんこれら以外の様々なの記載例・用例があります。）
日常の文章での例：以下は、「有無」が入っている日常の文章の例として作成したものです。
日本語で「有無」となっていても「existence or non-existence」;「presence or absence」がなくても成立するもの、または「有無」の意味が「existence or non-existence」;「presence or absence」が持つ意味とは違うもの、様々です。
(1)技術者の技術の差は、経験と研鑽の有無から生じる: (a) Differences in the technical skill of engineers arise from the presence or absence of his or her experience and self-improvement.⇒ (b) Differences in the technical skill of engineers depend on his or her experience and self-improvement.
(2)申請書の記入漏れがないか確認してください: (a) Check for presence or absence of omission of the application form. ⇒(b) Check for any omission of the application form.
例文の出来具合はともかくとして、多分普通は、いずれも(b)になるかと思われます。
その他、辞書には、「（本人の意思にかかわりなく）～される（させる）＝（有無をいわせず～される（させる）」について、例えばHe was forced to impose the responsibility without consideration of his wishes. He is appointed to a responsible person whether he is willing or not.などパターンの例文が掲載されていることがあります。（これらは当方で作成した文章です。もちろん「有無をいわせず～される（させる）」として訳す必要はありません。）いずれにしても様々な訳し方があるようです。
契約書・法律文などでの例：
The parties hereto shall not assume any liability for damages, regardless of the presence or absence of the infringement of intellectual property right of any third party, in regard to the Confidential Information disclosed and used by the other party.
This Agreement shall be terminated at any time and for any reason if the other party violate the terms and conditions hereof.
This Agreement shall be, with or without cause, terminated at any time and if the other party violates the terms and conditions hereof.
whether or not the certified public accountant or the auditing corporation has an interest in the client company being audited, etc.（当該公認会計士又は当該監査法人の被監査会社等との利害関係の有無）（公認会計士法施行規則）
「有無」についていくつかの例をあげてみました。日本語の「有無」の意味は、内容・文脈により多岐にわたります。そのため内容・文脈に合わせて「existence or non-existence」;「presence or absence」を使うのが適切な場合もあれば、それ以外の単語やフレーズを組み合わせて文章を作成する等、「有無」についての訳し方は様々です。
2. 「可否」
「可否」を聞く語辞典で見てみると、「良いか、悪いか」「事の良し悪し」、「賛成と不賛成：賛否」、「可決と否決」、「受け入れることができる、受け入れることがでない」等の意味が記載されています。「事の良し悪し」の意味では、「事の是非」、「事の当否」などの表現があります。「可否」を和英辞典で見ると、まずは「right or wrong」、「advisability」などが出てきます。ただし実際には日・英、英・日にかかわらず、「可否」に対応する言葉は、文脈により様々な言葉が使われます。
子細に見るには取り上げる範囲が相当広範な内容になります。このブログの主旨は、「とりあえず知っておくと便利な事柄」なので、その部分にしぼっていくつかの例を取り上げてみたいと思います。
この言葉は日常でも使われます。まずはそのあたりから見てみます。
I have not decided whether or not I can accept his offer yet. （彼の申し出を受け入れられるかどうかはまだ決めていません。)
He offers a proposal to be argued as pros and cons.（賛否両論として議論される提案を提示する）
He asked him whether or not the matter to be approved or disapproved. （彼は私たちにその件が承認されるか不承認になるか尋ねました。）
契約書等の例：
「可否につき協議を行う」⇒When either party proposes to change the specifications based on the preceding paragraph, the parties shall consult with each another for the change and right and wrong of such change without delay.
「その利用の可否を判断し（利用できるか、利用できないかを判断）」⇒If the Party A’s customer desires to use the System, Party B shall determine whether the System is available to the customer or not at its sole discretion, and notify Party A of the result without delay.
In the case where a request under the provisions of paragraph (1) has been made, the council must decide whether or not to dismiss the counselor or the chief accountant.（第一項の規定による請求があつたときは、理事会は、その参事又は会計主任の解任の可否を決しなければならない。）（中小企業等協同組合法）https://www.japaneselawtranslation.go.jp/en/kwic
「議長がその可否を議場に諮ったところ」⇒When the chairperson took a vote on such agenda, it was unanimously approved. Based on this, when the chairperson designated the person mentioned below and then took a vote on such designation, it was unanimously approved. 「take a vote on a matter」で「投票で可否を決する」の慣用句。「When the chairperson asked for a vote on such agenda,」などともできます。
何気なく使っている言葉でも、短かい簡単な言葉ほどその持つ意味が深いようです。例文に訳文が付いている場合、それらの訳文は暫定訳です。
