契約書翻訳の視点から知っておくと便利な良く目にする言葉を取り上げています。契約書は当事者間の権利と義務を規定します。以前、「「責任」や「義務」を意味する用語の例として、Responsibility、Obligation、Liability、Dutyについて取り上げましたが、今回は、権利者と義務者を表す用語について見てみます。
「権利者」と「義務者」という言葉というタイトルで書いていますが、「権利者」と「義務者」という言葉は単体で目にするよりも、多くの場合「～の権利者」、「～の義務者」のような使われ方をします。また、直接的に「権利者」と「義務者」という表現でなくても、例えば、債権者、債務者等のようにその言葉自体にその者や存在が「権利者」と「義務者」であることの意味をもっている場合も多くあります。
ところで「権利」とは、「一定の利益を追求し、主張し、享受することができる力。相手方に対して作為または不作為を求めることができる権能。相手方はこれに対応する義務を負う」（法律用語辞典）とあります。例えば、obligeeは、債権者ですが、AがBに対して一定の行為（給付）を請求できる権利を持つAを指し、Bはその給付義務を負う者である債務者： obligorとなります。債権者、債務者を表す英単語は、これら以外にも、例えば債権者であれば、creditorとか、債務者であればdebtorなどがあります。

義務者は、法律上、特定の義務を負うべき人のことです。
obligor：債務者；義務者
debtor：債務者
Taxpayer：納税義務者
the person obliged to disclose：開示義務者
Person Liable to Pay Customs Duties：納税義務者
electronically recorded claim obligor：電子記録義務者
Person Responsible for Payment：支払い義務者
the person obliged to register：登記義務者
If an obligor voluntarily fails to perform any obligation, the obligee may request the enforcement of specific performance from the court; （債務者が任意に債務の履行をしないときは、債権者は、その強制履行を裁判所に請求することができる。）
Where a party makes a taxable supply to another party, the recipient must pay to the suppler an additional amount equal to the Consumption Tax based on the tax invoice received by the Recipient.（一方当事者が他方当事者に対して課税対象物を提供した場合、受領者は、受領者が受領したタックスインボイスに基づく「消費税」に相当する追加額を提供者に支払わなければならない）
Even after the obligee has made a demand to the principal obligor in accordance with the provisions of the preceding Article, the obligee must first execute on the property of the principal obligor if the guarantor proves that the principal obligor has the financial resources to pay the obligation and that the execution can be easily performed. （債権者が前条の規定に従い主たる債務者に催告をした後であっても、保証人が主たる債務者に弁済をする資力があり、かつ、執行が容易であることを証明したときは、債権者は、まず主たる債務者の財産について執行をしなければならない）（民法）
「権利者」、「～の権利者」、「義務者」、「～の権利者」または「それら類する意味を持つ言葉」について簡単に触れてみました。これらに関するいくつかの例をあげましたが、ほんの一例であり、ある特定の分野で用いられる言葉‐用語はこれら以外にも多くあります。
