契約書翻訳の際に英文契約書でよく目にする「規定する」、「規定されている」という表現は、いずれも契約書や法律文書の頻出用語の1つです。もちろん技術文書をはじめその他分野でも使われていますが、今回も契約書翻訳の視点から「規定する」、「規定されている」または時として「定める」の意味を表すいくつかの英語表現を作成した例文（法律文を除く）を通して契約書翻訳の視点からみてみます。
以下は「規定する」、「規定されている」を表す主な単語です。
provide、regulate、stipulate、prescribe、define、specify、set forth= which is set forth
1. provideを使用したもの
一般にfurnishと並んで「提供する」の意味として理解されている場合も多いかもしれません（主観的な意味としてですが）。英文契約書では、文脈的に「規定する」の意味で使用されるケースが多く見受けられます。もちろん、英文契約書においても「提供する」の意味で使用されることも多々あります。
This Agreement provides the Contractor’s obligations under this Agreement. （本契約は、本契約に基づく契約者の義務を規定する）
Any matter not provided for in this Agreement shall be settled based on a consultation between the parties hereto in good faith. （本契約に定めのない事項については、本契約の当事者間で誠意をもって協議し、解決するものとする）
The Contractor shall provide the Customer with the services under this Agreement. （請負業者は、本契約に基づいて顧客にサービスを提供する）
Except as otherwise expressly provided herein, this Agreement may not be assigned to third parties without the consent of the other party hereto.（本契約に別段の明示的な規定がある場合を除き、本契約は、相手方の同意なしに第三者に譲渡することはできない）
2. specifyを使用したもの
「指定する」、「明確にする」、「明記する」などに意味で使用されますが、以下の例文のように「規定する」、「規定されている」の意味でも使われます。
“Site Manager” means the person who shall perform the duties specified in the Attachment. （「現場管理者」とは、別紙に定める職務を遂行する者をいう）
If the Contractor fails to comply with its obligations specified in this Agreement, the Customer may terminate this Agree specified in this Agreement. （請負業者が本契約に規定された義務を遵守しなかった場合、顧客は、本契約で指定された本契約を解除できる）
そのほか、1つの例として副詞としてspecificallyの形で、「明確に」、「具体的に」、「特に」の意味でも使われています。
The Company shall not disclose any Confidential Information to any person or entity other than as specifically permitted by this Agreement. （会社は、本契約において明示的に許可された以外のいかなる個人もしくは存在に対しても、いかなる機密情報も開示しない）
3. regulateを使用したもの
通常「規制する」、「調整する」などの意味で使われることが良く見られます。
The Government issues a new atmospheric pollution prevention act that more strictly regulate air pollution in comparison with the current the laws and regulations. （政府は、現行の法規制に比べて大気汚染をより厳しく規制する新しい大気汚染防止法を公布する）
The service engineers regulate the machine every three months.
The furnace temperature is always regulated.
実際、経験上も契約書でregulateが文脈的「規制する」、「調整する」の意味として使われる場面が多いように感じます。The Management Committee are entitled to regulate and investigate the matters dealt with in this Agreement. (管理委員会は、本契約で扱われる事項を規制および調査する権利を有する)
regulateが文脈的に「規定する」の意味で使用される例としては、
The Contract of Employment shall regulate the rights and obligations of the employees.
（雇用契約は、従業員の権利と義務を規定する）
This paragraph regulates to prevent unjust sales regarding the Products under this Sales Agreement. （本項は、本売買契約に基づく商品の不当な販売を防止するために規定する）
