今回は、「発効」と「有効」について簡単に触れてみたいと思います。この言葉は契約書に限らず、法律文書では定番の用語です。例えば、「発効」は、法律、契約、条約を問わず、これらは発効させなければその効力を生じません。発効の意味を改めて確認すると、「発効」とは、「法律や規則などの＊効力が発生すること」とされています。（＊一般に、一定の働き、効果を及ぼすことができる能力）
「発効」という言葉がくると「有効」という言葉が浮かびます。「発効」と関連性がある言葉なので、一応触れておきます。
「有効」は、法律、契約、条約等の法律文書で使われる場合の意味は、「法律上の効力をもっていること」ですが、例えば、以下に作成した例文のように、多くの分野で日常的に使われています。
Turn on control power again to make the self-inspection function becomes effective.
（制御電源を再度ONにして、自己点検機能を「有効」にします。）
The operator can stop the machine immediately, which is effective after its initialization.
(オペレータは装置をすぐに停止できます。これは、装置の初期化後に「有効」になります。)
この場合の「有効」は、一般的に「効果をもたらす能力がある」の意味です。

有効な：「effective」、「valid」、「efficacious」、「available」、「effectual」など
有効になる：「become effective」、「come into effect」、「take effect」など
発効する：「become effective」、「come into effect」
有効である：「be effective」、「be valid」、「be available」など
2. 英文契約書などでの使われ方の例
「発効」と「有効」について作成した例文をとおして、知っておくと便利な英文契約書でのいくつかの使われ方を作成した例文（法律文書を除く）などを通して、契約書翻訳の観点から見てみます。
The termination of this Agreement shall be effective immediately upon a delivery of notice of termination thereof from the Licensee to the Licenser. （本契約の解除は、ライセンシーからライセンサーへの解除通知の送達と同時に発効する（有効になる））
The Services provided by this Agreement shall be performed in an efficient and effective manner. （本契約により提供されるサービスは、効率的かつ効果的な（有効な）方法で実行される）
If the Buyer purchases the goods under this Agreement from the Supplier, the Buyer shall pay to the Supplier the amount specified in valid taxable invoice. (買主がサプライヤーから本契約に基づいて商品を購入する場合、買主は、有効な課税対象の請求書に指定された金額をサプライヤーに支払う)
This Agreement is valid for any and all transaction between the parties of this Agreement.（本契約は、本契約の両当事者間のあらゆる取引に対して有効である)
The effective period of a Long-Term Care Support Specialist Certification shall be renewable by the submission of an application. （介護支援専門員証の有効期間は、申請により更新する）（介護保険法）
発効、有効を表す主な英語表現の中で、よく使われるもののひとつに「become effective」の表現があります。「発効する」、「有効になる」の意味です。いずれの表現をどのように使うかは、文脈によります。
This Agreement shall become effective upon acceptance by the Recipient.（本契約は、受領者が承認した時点で発効する（有効となる）。）
The merger shall become effective upon the completion of the procedure for merger.（合併は、合併手続が完了したときに発効する（効力を生ずる）)
This Agreement shall become effective as of xxxxx, 20xx and expire on xxxx, 20xx (本契約は、20xx年 xxxxxに発効し、20xx年 xxxxxに満了する)
「become effective」を使わないでも以下のようにすることもできます。
This Agreement shall be effective as of the date of execution of this Agreement. （「本契約は、本契約の署名日の時点において発効する」
だいぶ前になりますが、「有効」「無効」等について書いたことがあります。今回は、その時の内容の補足です。
