今回は、「履行」、「～を履行する」の表現について契約書翻訳の関連から見てみます。
「履行」、「～を履行する」という表現（例えば、契約を履行する、義務を履行する、債務をする等）は、契約書に書かれる定番の文言です。「履行」の意味を国語辞典で見ると、「決めたこと、言ったことなどを実際に行うこと。実行」とあります。法律用語辞典を見ると、「一般用語では、広く「一定の義務を実行すること－中略－債務者が債務の内容を実現すること－中略－弁済と同義であるが、弁済は債務の消滅の面からとらえているのに対し、履行は債務の効力の面からみたもの」となっています。
日本語で「履行」という漢字2文字で表されるこの言葉の、英文の場合、文脈上「履行」、または「履行する」と解される単語や成句がいくつもあります。そこで、履行」、または「履行する」を意味する英単語や英単語の組み合わせを少し調べてみました。
和英辞典やいくつかの法律関連の書籍を見ると英語で「履行」や「履行する」を意味する主な言葉としては、「performance」、「perform」、「fulfillment」、「fulfill」、「carry out」、「execution」、「execute」、「implementation」、「implement」が多く見受けられました（これらの言葉以外にも、文脈上「履行」、または「履行する」と解される言葉がありました）。
例えば、「契約の履行」や「彼は契約を履行する」を調べてみると、the execution of a contract; fulfillment of a contract; the performance of the contract. He performs a contract; He fulfills a contract; He completes the contract; He implements a contract; He carries out a contractなどと、少し調べただけで様々な言葉が使われています。
ここでは、これらの中でも、英文契約書で文脈上「履行」や「履行する」の意味で、比較的多くみられる「performance」、「perform」、「fulfill」、「fulfillment」、「implementation」、「implement」についての使われ方を見てみます。なを、英単語の例にもれず、これらの単語は、「履行」や「履行する」以外にも多くの意味をもっています。
1. 「performance」、「perform」
見ての通り、performanceは名詞、performは動詞です。「履行（実行）」や「履行（実行）する」という意味では、一般的な表現で、和文英訳などの場合も、無難につかうことができるようです。作成した例文を通してみてみます（法律文を除く）。
In performing its obligations under this Agreement, the Contractor shall perform the duties specified in this Article .(本契約に基づく義務を履行するにあたり、請負業者は本条に規定された義務を履行する)
“Site Manager” shall be the person nominated by each party (and notified to the other party) and shall perform the duties specified in this Agreement.（「サイトマネージャー」は、各当事者によって指名された（および相手方に通知された）人物であり、本契約で指定された職務を遂行する）
If a person who has received a testamentary gift with burden does not perform the duty imposed thereby, an heir may demand performance of that duty fixing a reasonable period to do so.（負担付遺贈を受けた者がその負担した義務を履行しないときは、相続人は、これを行うために相当の期間を定めてその義務の履行の催告をすることができる。）（民法）
If either of the parties fail to perform its respective obligations, such party shall take responsibility for that failure and compensate the other Party. (いずれかの当事者がそれぞれの義務を履行しなかった場合、当該当事者はその不履行に対して責任を負い、相手方に補償する)
「perform～」の場合 “Acceptance Tests” means the tests and procedures that shall be performed in accordance with the Equipment Specifications.
（「検収（受け入れ）試験」とは、機器の仕様に従い実施される試験および手順を意味します。）
The performance by the Contractor of all its obligations under this Agreement shall be an essential requirement thereof. (本契約に基づくすべての義務の請負業者による履行は、本契約の必須要件)
2. fulfll、fulfilment
「履行」という意味で見ると辞書では（義務・職務などを）果たす，遂行する；fulfill one’s promises：約束を果たす（履行する）などと書かれています。
The Contractors shall be required to maintain the working capital and net worth to fulfill its responsibilities under this Agreement. (請負業者は、本契約に基づく責任を履行する（果たす）ために運転資金と純資産を維持することが求められる)
Licensor may not fulfill its duty for any loss or damages due to force majeure. (不可抗力による損失または損害については、ライセンサーはその義務を果たさない場合があります。)
Any non-fulfillment of duties under this Agreement may become the ground of the termination of this Agreement. （本契約に基づく義務の不履行は、本契約の解除事由となることがある）
上記1.「performance」、「perform」で触れたように「履行」の意味で使われていても、一律に「履行」とはせず、文脈的に適切な言葉を置きかえることも多くあります。
The Company shall reserve sufficient production capacity and maintain sufficient inventories to promptly fulfill the requests by the customers（お客様の要望に迅速に対応できるよう、十分な生産能力を確保し、十分な在庫を確保）

- implement、implementation
上記と同様に「履行」という意味で見ると辞書では（契約・計画）を履行する，実行する，実施する、（要求・条件・不足などを）満たす等が書かれています。
With regard to implementation of this Agreement, the Company shall not violate any laws and regulations to implement this Agreement.（本契約の履行に関して、会社は、本契約を履行するための法令に違反しない。）
The Contactor make every effort to maintain and implement the safety procedures of the network security.（請負業者は、ネットワークセキュリティの安全手続きを維持じ、履行（実施）するためにあらゆる努力を行う）
