これまで何回か、「英文契約書における文頭の否定」というタイトルのブログを掲載してきました。今回は、それらの要点を契約書翻訳の視点から改めてまとめてみました。
1. 文頭の否定とは
以前にも触れましたが、英文契約書の中には普通の文書にはあまり見られない文頭に例えばNoやNonなど、否定を意味する接頭語が始まる言葉が多々見られます。例えば、「In no event shall～」に導かれるその後の文章部分は、[～でない]の意味になります。例：In no event shall someone be liable for ……………（いかなる場合も（人は）…………に関して責めを負わない。）
「In no event shall」のほかにも、文章の文頭に否定を意味する語句が置かれると、その後に続く文章は、通常肯定文もスタイルとなりますが、文章全体としては、否定文になります。
このスタイルは英文契約書に限らず、英文において一般的に見られることです。今回も契約書翻訳の観点から見てゆきます。
口語英語でも、「No xxx, No life」と言うように、XXXがないと生きていけないなどの表現もあります。絶対、何か欲しいとき、何かしてほしいときなどに使用します。
例えば、音楽好きなら、「No music, No life.」 お菓子が好きなら、「No cookies, No life.」、「No chocolates, No life.」などとなります。 英文契約書に目を移してみるとこの表現のスタイル（文章（または言葉）の先頭に否定を意味する語句を使う）は、契約上、例えば「あれをしてはいけない」、「これをしてはいけない」との意味で、契約の当事者、相手方、関係者に対してなんらかの規制をかける場合、良く使われます。
2. 文頭の否定と普通の否定文

例えば、チケットの変更ができない場合「チケットの変更はできない「We can make no changes～」の様に、言い切ってしまうといささか相手に対して強い調子になり、これを「No changes can be made to the tickets.」とすると一見事務的ですが、「チケットの変更はできないことになっています」事実関係を述べているだけで、「決まりですので、ご了承の程、お願いします。」というニュアンスがあります

文頭の否定に関していくつかの類型を見てきましたが、前回も書きましたが、自分で否定内容の文章を起草する場合、なれないうちは、文頭に否定の形式ではなく、いわゆる「普通の否定文」を使うのが良いかと思われます。
