英文契約書に限らず、法律文書等でお目にかかるのが「委託」と「受託」という言葉です。
今回は、特に「entrust」とentrustの名詞形「entrustment」を使用した「委託」と「受託」の表現を中心に契約書翻訳の観点から見てゆきます。委託」と「受託」は、下にも書きましたが、普通の言葉で言えば、「まかせる」と「引き受ける」ということです。これらの単語の主な意味としては、「entrust: 任せる、委託する、委任する、預ける、信託する」。「entrustment: 委託」です。「委託」に対応する言葉は、「受託」です。「委託」という言葉が使われる「業務委託契約」などは、翻訳依頼が多い契約の1つです。
「委託」と「受託」の意味を改めて法律用語辞典でみると、
「委託 ：一般的に法律行為または事実行為を他人または他の機関に依頼すること……。」「受託：一般的に委託、委嘱、あるいは請託を受けること……。」とあります。
難しく考えなくても国語辞典を見ると、「委託：ゆだね任せること、人に頼んで代わりにやってもらうこと」、「受託：頼まれて引き受けること。」とあります。
ここではそれぞれに使用される単語の知っておいて損はない具体的な用例の一部をとりあげます。
1. 「entrust」と「entrustment」他を使用した「委託」の表現
「委託」や「委託する」を表す単語は、「entrust」と「entrustment」の他にも、trust、 consignment、charge、commission、delegate等多くの単語がありますが、これらについては後述します。
ここでは「entrust」を中心に作成した例文を通していくつかの用例を見てみます（法律の条文を除く）。
なを、「entrust」を使った「委託する」の表現のパターンは、例えば「A person entrusts someone with something」,「A person entrusts something to someone」などです。
I entrust my business with him.(自分の仕事を彼に委託する)
I entrust him to my business .(自分の仕事を彼に委託する)
Party A shall entrust Party B with the sales of Party A’s products (hereinafter referred to as “Products”) for areas designated by Party A. (当事者Aは、当事者Aが指定した地域での当事者Aの製品（以下「製品」という）の販売を当事者Bに委託する)
Payment date and method are entrusted with the Board of directors. (支払日と支払方法は取締役会に委任されている)
Party A shall not entrust all or part of Party A’s business related to this Project to any third party without a prior written consent by Party B.(甲は、乙の事前の書面による承諾無しに、本プロジェクトに関連する甲の業務の全部若しくは一部を第三者に委託してはならない。)
A trust company may entrust a third party with part of its trust services as regards trust property that has been placed in trust with it only if all of the following requirements are fulfilled:（信託会社は、次に掲げるすべての要件を満たす場合に限り、その受託する信託財産について、信託業務の一部を第三者に委託することができる。）（信託業法）
A prefectural governor, etc. may delegate custody of dogs and cats to an organization established for the purpose of animal welfare. （都道府県知事等は、動物の愛護を目的とする団体その他の者に犬及びねこの引取りを委託することができる。）（動物の愛護及び管理に関する法律）
The Seller shall entrust the customs clearance of the Goods to the local agent. （売主は商品の通関手続きを現地代理店に委託する）。

「entrust」の代わりに「trust」を使用することもできますが、一般的には「entrust」が使用されています。
2. 「entrust」と「entrustment」他を使用した「受託」の表現
「受託」を１語で表す単語は、trust、requisition、contract等があるようですが、「entrust」使った「受託する」の表現は、例えば「be entrusted with something」等となります。この場合「受託する」は「～を任せられる・～を委託される・委託を受ける＝～受託する」と表現されます。trustを使う場合は、「be given something in trust」。
例えば、 A person who is entrusted with the services under paragraph (1) may not entrust the entrusted services to another person.（第一項の規定により業務の委託を受けた者は、当該委託に係る業務を再委託することができない。）（金融商品取引法）
entrusting or becoming entrusted with one of the acts listed in the preceding items, or undertaking a request to brokerage such entrustment.(前各号のいずれかに掲げる行為の委託をし、又はその受託をし、若しくはその委託の取次ぎを受託すること)（商品先物取引法）(http://www.japaneselawtranslation.go.jp/kwic/?re=01)
The sales agent shall be entrusted with sales of the Products based on this Agreement within the sales territory. (販売代理店は、販売地域内での本契約に基づく製品の販売を委託される）
The executive officer (who is) entrusted with the day‑to‑day management shall be appointed by annually meeting of the board of directors. (日常の管理を委託された執行役員は、毎年、取締役会により任命される)
