前回の「英文契約書の用語・単語 「規定する」の表現（その1）」続きです。前回は、「規定する」、「規定されている」、時として「定める」を表す主な単語（provide、regulate、stipulate、prescribe、define、specify、set forth= which is set forthなど）の中から、「provide」、「specify」、「regulate」についての用例として作成した例文を通して見てみました。今回は、「stipulate」、「prescribe」」について作成した例文（法律文を除く）を通して契約書翻訳の視点から見てみます。なを、「規定する」の使われた方で以外の知っておくと便利なことについても触れてみます。
1. stipulateを使用したもの
辞書を見ればわかるように、この言葉の主な意味「～を規定する」、「～を明記する」、「～を約束する」、「～を請け負う」ですが。そのほか、stipulate forとして「～を要求する」などに意味がありますが、経験的にはあまり見かけたことはありません。
The trademark of the manufacturer shall be stipulated in all products to be sold in the its domestic markets. （製造業者の商標を、国内市場で販売されるすべての製品に明記する）
All raw materials and parts stipulated in this paragraph supplied by the customer to the manufacturer shall be deemed to be the customer’s property. （顧客が製造業者に提供する、本項に規定するすべての原材料および部品は、顧客の所有物とみなされる）
「～を規定する」の意味で使用する場合、文脈的に「～を定める」とする場合もあります。
The delivery schedule of the Products shall be stipulated in each separate agreement.（製品の納期は、それぞれの別途契約に定める（規定する）ものとします。）
City Plans Stipulated by the Minister of Land, Infrastructure, Transport and Tourism. （国土交通大臣の定める都市計画）（都市計画法）https://www.japaneselawtranslation.go.jp/en/kwic
2. prescribeを使用したもの
この言葉は、日常的には「（薬などえを）処方する」などの意味で使われることが多いかもしれません。ちなみに名詞のprescriptionは、「規定」、「指示」などの意味のほかに「（医師の）処方箋）」の意味もあります。文脈的に「定める」とすることもあります。なを、法律でいう「時効」も多くはprescriptionを使用します（他の用語もあります）。
Specifications means any specifications prescribed by the manufacturer from time to time for or in relation to the Products. （仕様とは、製品に関して、または「製品」に関連して、その時々において（随時）製造業者が規定する（＝定める）仕様を意味する）
Proxy shall be in the form prescribed under the Act. 「規定する」（委任状は法律に規定する（＝定める様式による）
Either party may terminate this agreement by giving the other party six (6) months’ written notice before the end of the initial period or any subsequent renewal period prescribed herein.（いずれの当事者も、本契約に規定されている当初期間またはその後の更新期間が終了する6か月前に書面で通知することにより、本契約を終了することができる）
The competent minister shall prescribe required items in relation to accounting of net asset amounts in addition to the items set forth in the preceding paragraphs. （前各項に規定するもののほか、純資産額の計算に関し必要な事項は、主務大臣が定める）（商品先物取引法施行規則）https://www.japaneselawtranslation.go.jp/en/kwic

そのほか「所定の」の表現で使用されることもあります。「所定の」の表現は、の他、「fixed」、「appointed」などを使う場合もあります。
If the Employee has been working for six (6) months and reported for work more than eighty (80) percent of the prescribed working days since he or she joined the Company, ten (10) days of the annual paid leave shall be granted.（従業員が入社して6ヶ月間継続勤務し、所定労働日の8割以上出勤した場合には、次の1年間に10日の年次有給休暇を与える）
